§ 1-14. General penalty; continuing violations.

  • (a)

    It is a violation of this Code for any person to do any act which is forbidden or declared to be unlawful or to fail to do or perform any act required by this Code.

    (b)

    Whenever in this Code or any other ordinance of the town hereafter enacted or any section of an order, rule or regulation promulgated under the provisions of this Code or any other ordinance hereafter enacted, any act is prohibited, made or declared to be unlawful, an offense, nuisance or misdemeanor, where no specific penalty is provided therefor, any person who is convicted of the violation of any such provision of the Code or other ordinance, or of such orders, rules or regulations, shall be punished by a fine not to exceed $2,650.00 or imprisonment not to exceed one year, or both such fine and imprisonment.

    (c)

    Every day any violation of the Code, any other ordinance of the town or any order, rule or regulation promulgated under the provisions of this Code or ordinances continues shall constitute a separate offense.

    (d)

    The imposition of a penalty does not prevent the revocation or suspension of a license, permit or franchise or any other administrative sanctions authorized by law.

    (e)

    In addition to the penalties hereinabove provided, any condition caused or permitted to exist in violation of any of the provisions of this Code or any such ordinance, resolution, rule, regulation or order shall be deemed a public nuisance and may be abated by the town through injunctive or other equitable relief and by such other means as provided by law. The imposition of a penalty does not prevent equitable relief.
