§ 20-159. Resisting an officer; escaping; rescuing a prisoner.

  • (a)

    It shall be unlawful for any person to resist any peace officer, any member of the town marshal department, or any person duly empowered with police authority, while in the discharge or apparent discharge of his duty, or in any way to interfere with or hinder him in the discharge of his duty.

    (b)

    It shall be unlawful for any person to offer or endeavor to assist any person in the custody of a peace officer, a member of the town marshal department or a person duly empowered with police authority to escape or to attempt to escape from such custody.

    (c)

    It shall be unlawful for any person to rescue or to attempt to rescue any person in the custody of a peace officer, a member of the town marshal department or a person empowered with police authority.

    (d)

    Any person convicted of violating this section shall be punished by a fine of not less than $50.00 nor more than $300.00, or by imprisonment in jail for a term not exceeding 90 days, or by both such fine and imprisonment.
