§ 24-33. Monthly rates for water service.

  • (a)

    The monthly rate for water service will be as set out in the town's master fee schedule. For those properties that are not receiving water service but have a tap into the water system, the owners of such properties shall pay the charges set out in the town's master fee schedule for availability of service and for fire protection and administrative service. Separate rates for industrial and commercial users have not been established at this time. Until the board of trustees establishes such separate rates, industrial and commercial users shall pay the same monthly rate for individual property owners as set out in the town's master fee schedule.

    (b)

    Any qualifying senior who is registered with the town clerk may obtain a monthly credit toward their monthly water bill equal to $5.00 for their primary residential household at which they receive water service from the town.

    To register with the town clerk and to obtain the monthly credit, a qualifying senior must appear in person before the town clerk and present photo identification that bears the qualifying senior's date of birth showing that the qualifying senior has obtained the age of 65 years and present a copy of either a written lease showing that the qualifying senior is a named lessee of the qualifying senior's primary residence or a copy of a deed recorded in the real property records of the county clerk and recorder's office showing that the qualifying senior is a named grantee of the qualifying senior's primary residence. The primary residence must receive water service from the town and be located within the incorporated boundaries of the town. If the qualifying senior is an owner or lessee of more than one residential property within the town and receives water service at more than one residential property within the town, the residential property at which the qualifying senior spends at least 183 nights throughout a calendar year shall be deemed the qualifying senior's primary residential property. In no circumstances can a qualifying senior receive a monthly credit for more than one property at a time. In no circumstances will a primary residence receive more than one monthly credit at a time.

    Qualifying seniors may register with the town clerk on or after December 1, 2009. The monthly credit shall be effective beginning January 1, 2010. Qualifying seniors whose 65th birthday occurs on or after January 1, 2010, may register with the town clerk on or after the first business day of the month following their 65th birthday and the monthly credit shall be effective on the billing cycle. It is the responsibility of the qualifying senior to register for the monthly credit and to update the town clerk of any changes in eligibility or changes in primary residence.

    If the qualifying senior's primary residence changes or if the residential household receiving the monthly credit ceases to qualify for the monthly credit, the monthly credit shall end at the end of the calendar month in which the disqualification occurred. If the town clerk receives information that the residential household receiving the monthly credit is disqualified from receiving the monthly credit for any reason, the town clerk shall send notice that the monthly credit shall end at the end of the calendar month in which the town clerk was notified of the disqualification, unless the qualifying senior appears in person before the town clerk and presents evidence of continued registration eligibility.

    (c)

    The owner of any building, house, trailer, vacant lot or other premises upon which a pool holding 1,000 gallons of water, or more, is located shall be assessed a one-time per year charge as established by action of the board of trustees from time to time and set out in the town's master fee schedule, which charge is to be assessed and paid in advance, in May of each year. The pool charge will be waived if the owner can demonstrate that the pool will not be filled or refilled from the town water system in the succeeding 12 months.
