§ 6-29. Adoption of codes; amendments.

  • The town adopts the following codes for the purpose of regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal, maintenance, and demolition of detached one- and two-family dwellings and multiple, single-family dwellings (townhouses) not more than three stories in height with separate means of egress and regulating and governing the conditions and maintenance of all property, buildings, and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary, and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures in the town; and providing for the issuance of permits and collection of fees therefor:

    (1)

    The International Building Code, 2009 edition, is hereby adopted by the town.

    (2)

    The International Building Code, 2009 edition, adopted in subsection (1) of this section, is hereby amended as follows:

    a.

    101.1 Title. These regulations shall be known as the Building Code of Log Lane Village, Colorado, hereinafter referred to as "this code."

    b.

    Adopt appendix B, board of appeals.

    c.

    Delete section 109.2 in its entirety and substitute as follows:

    109.2 Schedule of permit fees. On buildings, structures, mechanical systems, or alterations requiring a permit fee, a fee for each permit shall be paid as determined by a schedule of fees adopted by motion by the board of trustees. The determination of value or valuation under any of the provisions of this code shall be made by the building official.

    d.

    Delete sections:

    101.4.3: Plumbing
    101.4.4: Property maintenance
    101.4.5: Fire prevention
    105.2 (partial): Delete "electrical" from list of exemptions
    107.2.2: Fire protection system shop drawings
    B101.3.3: Ability of appellant to postpone hearing if less than full board is present

    e.

    Add/amend sections:

    Add 104.1.1: The building official and any appointed deputies shall have the duty of ensuring that all construction-related aspects of town zoning ordinances and regulations and any conditions or permits or variances issued under those codes, including, but not limited to, setbacks, height restrictions, number of buildings per lot, floodplain regulations, mobile home tie-downs, etc., are met.
    Add 105.2: Work exempt from permit.
    Agriculture buildings as defined in section 202.
    Sheds, pole barns, garages or other outbuildings that do not contain sleeping quarters.
    202 Definitions: Agriculture building - A structure designed and constructed to house farm implements, hay, grain, poultry, livestock, or other horticultural products. This structure shall not be a place of principal employment where agricultural products are processed, treated, or packaged, nor shall it be a place used by the public.
    Add 3106.6: All marquees shall conform to the zoning ordinances and regulations of Log Lane Village.
    Add 3107.2: All signs shall conform to the zoning ordinances and regulations of the town.
    Delete B101.2.2: In its entirety and replace with, "The board of appeals shall consist of five individuals."
    Delete B101.4: In its entirety and replace with, "The board's decision to uphold, reverse, or modify a decision of the building official shall be by vote of a quorum majority of board members present at a hearing."
    1612.3: Establishment of flood hazard areas. The most recent version of the flood insurance rate map (FIRM) for the town and the floodplain overlay areas adopted by the board of trustees for the town.
    3412.2: Insert effective date of this ordinance, i.e., June 8, 2011.

     

    f.

    The Specifications for Regulating Excavations/Construction within Public Ways, Policy 001, attached to Resolution No. 1-16, adopted by the board of trustees on October 12, 2016, a copy of which is on file in the town clerk's office and available for inspection during normal working hours.

    g.

    The Application for Permit to Work within Public Way attached to Resolution No. 1-16, adopted by the board of trustees on October 12, 2016, a copy of which is on file in the town clerk's office and available for inspection during normal working hours.

    (3)

    The International Residential Code, 2009 edition, is hereby adopted by the town.

    (4)

    The International Residential Code, 2009 edition, adopted by subsection (3) of this section is hereby amended as follows:

    a.

    Section R101 Title. These provisions shall be known as the Residential Code for One- and Two-Family Dwellings of Log Lane Village and shall be cited as such and will be referred to herein as "this code."

    b.

    Adopt appendix E

    c.

    Replace Table R301.2(1) as follows:

    Delete section R108.2 in its entirety and substitute as follows:

    f.

    Add/amend sections:

    Amend R105.1: Exception 1 delete "200 square feet" and replace with "120 square feet."
    Amend R315.1: For new construction, an approved carbon monoxide alarm shall be installed within 15 feet of the entrance to each bedroom in dwelling units within which fuel-fired appliances are installed and in dwelling units that have attached garages.
    Amend R315.1.1: Add exception that work involving the exterior surfaces of dwellings, such as the replacement of roofing or siding, or the addition or replacement of windows or doors, or the addition of a porch or deck, are exempt from the requirements of the section.

    The International Mechanical Code, 2009 edition, is hereby adopted by the town.

    (6)

    The International Mechanical Code, 2009 edition, adopted in subsection (5) of this section is hereby amended as follows:

    a.

    IMC section 101.1 Title. These regulations shall be known as the Mechanical Code of Log Lane Village, Colorado, hereinafter referred to as "this code."

    b.

    IMC section 106.5.3 Fee refunds. Insert percentage in two locations, 50 percent.

    c.

    IMC section 108.5 Stop work orders. The dollar amount to be determined from time to time by resolution of the board of trustees.

    (7)

    The International Property Maintenance Code, 2009 edition, is hereby adopted by the town.

    (8)

    The International Property Maintenance Code, 2009 edition, adopted in sub section (7) of this section is hereby amended as follows:

    a.

    IPMC section 101.1 Title. These regulations shall be known as the Property Maintenance Code of Log Lane Village, Colorado, hereinafter referred to as "this code."

    b.

    IPMC section 302.4 Weeds. Insert height of four inches.

    c.

    Delete IPMC section 304.14 in its entirety.

    d.

    IPMC section 602.3 Heat supply. Insert dates of January 1 and December 31.

    e.

    IPMC section 602.4 Occupiable work spaces. Insert dates of January 1 and December 31.

    (9)

    The International Energy Conservation Code, 2009 edition, is hereby adopted by the town.

    (10)

    The International Energy Conservation Code, 2009 edition, adopted in subsection (9) of this section is hereby amended as follows:

    IECC Section 101.1 Title. These regulations shall be known as the Energy Conservation Code of Log Lane Village, Colorado, hereinafter referred to as "this code."

    (11)

    All fees associated with applications and permits related to the above adopted codes shall be determined by a schedule of fees adopted from time to time by resolution of the board of trustees and set out in the town's master fee schedule.

    (12)

    All other ordinances or parts of ordinances in conflict herewith are hereby repealed.

    (13)

    Nothing in this section or in the codes hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause of action acquired or existing, under any act or ordinance hereby repealed as cited in subsection (12) of this section; nor shall any just or legal right or remedy of character be lost, impaired, or affected by this section.
