§ 16-22. Penalties.

The following penalties, herewith set forth in full, shall apply to this article:

(1)

It is unlawful for any person to violate any of the provisions adopted in this article.

(2)

Any person convicted of a violation of any provision of this article shall be punished in accordance with section 1-14.

(3)

The penalties for specific violations of the Model Traffic Code may be set or modified from time to time by resolution of the board of trustees.

(4)

Pursuant to C.R.S. § 42-4-1701(4)(e), an additional surcharge of $17.00 shall be assessed for speeding violations under the Model Traffic Code for Colorado Municipalities, as revised in 2010, as adopted by the town.

(5)

The surcharge shall be paid to the clerk of the town municipal court by the defendant. Of the surcharge, $2.00 shall be retained by the town and the remaining $15.00 shall be transmitted to the state treasurer for credit to the Colorado Traumatic Brain Injury Trust Fund, within 14 days after the end of each fiscal quarter.

This surcharge may be modified from time to time by resolution of the board of trustees.
